As the facts of Sunday’s disturbing cat and mouse chase begin to unfold questions are now being asked if whether Alexian Lien may have gone too far in trying to get out of what he perceived to be harm’s way.

Told Christopher Cruz‘s lawyer,  H. Benjamin Perez after his client posted bail yesterday after being accused of initiating Sunday’s hostilities:

“His motorcycle was struck and he stood right there. He never assaulted this man, he never tried to assault him in any way, and he does not know any of the other motorcyclists who were involved in this beating.”

Told a witness to the confrontation, Jerome Davis: “If something happens, you stop right there. It’s an accident. You think and stop. You don’t keep reacting on,”

Except Alexian Lien didn’t just stay there, instead according to police reports Lien feared for his and his family’s life after the bikers alighted and purportedly began to slash at his tires.

That said some have speculated that Lien may have felt some degree of complicity and rather than face the potential wrath of 50 men decided to drive away, irrespective of who he might end up hurting.

And there was this discussion on tyt on who is actually complicit which went on raise a variety of questions:

Reflected one commentator on the web:

I still think Mieses is not at fault. I saw the video. Not once did Mieses approach Lien’s car, he didn’t attack Lien, in fact, he never did anything to Lien. The guy who provoked Lien was Christopher Cruz, not Mieses. Lien ran over a guy who never did anything to him. Now I understand Lien was fearful for his family, and he drove over a biker in fear, not intentional. However, in his action to save his child, he paralyzed someone who never did anything to him, and at the same time has created hardship for 2 children of the injured biker.

The very least he should do is be responsible for Mieses medical bills, along with Christopher Cruz, who is also at fault for provoking the incident. The biker gang stuff—I don’t buy it. Most of these guys don’t even know each other. Riders from all over the area congregate once a year for parade. it’s not a gang.

A lot of bikers ride in groups for safety. And yes it’s true many bikers ride crazy, but many car drivers drive crazy also. I drive on turnpike everyday, and I see many cars and suvs cutting me off all the time, do I run them over? nope. If I reacted like Lien I would have run over scores of people by now.

Road rage is a big problem and the solution is not violence. As far as the argument that he was only protection his child, in the video I don’t see bikers attacking the suv. I see most of the bikers just watching with a “whats going on?” look. A few bikers congregate near the suv, but that’s because there was an accident. Another factor: nobody knew he had a baby on board. the suv was tinted passenger windows to the whole back. all you can see is lien and his wife. and in any accident people always come out and see what happened, its normal.

Alexian Lien
The moment of impact…Lien trying to get away.

That said, authorities have also gone on to suggest that one of the bikers who surrendered themselves to authorities on Tuesday and who went on not to be charged, Allen Edwards may have sought to assist Lien.

Tells cnn‘s article: Edwards may have been trying to protect the driver of the SUV who had come under attack, according to one witness, a law enforcement official said.

Nevertheless commentators on the web have overwhelmingly gone on to support Alexian Lien’s actions that have resulted in the permanent paralysis of one of the bikers, Edwin Mieses (full name Jeremiah Edwin Mieses) with some arguing that that Lien did not inflict enough retribution.

Told Mieses’ mother, Yolanda Santiago:

“All of his ribs are fractured, his lungs are so badly bruised that he’s still on a ventilator.”

Mieses’ wife, Dayana Mieses said he had been trying to help the first biker who was initially hit by the SUV when he, too, was hit.

At present no charges are expected against Lien and the DA’s office is still investigating the incident although one wonders if and when Mieses’ family will seek to affect a lawsuit against Alexian Lien….?

  1. As a form cop, I glad to see that the officers got charged and I hope they lose there jobs. I know many cops feel the same way. We don’t need A holes like them in the ranks. Too bad NYPD can’t do a better job of weeding these mental cases out of the department. Further- Where was Highway 1. No one in authority has explained why when it was obvious that the westside hwy would be a travel route to and from the city, that no cops or even extra cops would be called in to patrol that hwy. Alexin Lien was in fear of his life and took appropriate action by leaving to protect his wife and kids. Why would a biker sit in front of an SUV knowing that he could get run over? BTW- I retired after 22yrs. of exemplary service. And I’m not one of those cops that gets $100.00.00 a yr. pension. I get approx. $ 45,000.00 a yr. Most cops do a good job but when your a screw up it hurts us all. I agree with jonquimbly, This was no accident. These actions were criminal caused by criminals. I also feel it’s time to pass a restriction on group bike riders, Need a permit for more than 10 in a group, with requirements that all in the group submit Drivers lic. and reg. If people don’t like it, too bad, Driving is a privilege not a right.

  2. This is the height of naivete. Christopher Cruz deliberately caused the accident and you expect Mr. Lien to apologize? And this while an enraged group of criminals are slashing your tires and attempting to forcibly open your doors?

How did you draw such bizarre conclusions in the face of overwhelming evidence against this gang of nefarious thugs? Please explain.

  3. Mieses’ family is a liar, they’ve got no one to blame but himself for being in the hospital! He had no reason to stop but to try to aid the gang of people attacking the SUV. Not ‘helping’ anyone but the gang! He boxed the Lien family in, as his tires were being slashed, theres pics of his entire wheel stripped, so he got ran over in the escape.

The fact that they even the wife’s and kids windows COMPLETELY CRACKED AND SHATTERED, shows they have no heart and would attack women and children! A good samaritan is quoted in new for stopping them as one grabbed Rosalyn Ng’s arm and said “we’re coming for you too!” The Mieses expect sympathy for ‘their family’ but stood on as this innocent family got attacked by 50 people???

Lets hope the judge will throw their frivolous lawsuit (as we all know they have no insurance, and Miese’ license in Mass. was suspended for years until 2017, multiple arrests with drug use). And the Mieses’ ‘dedicated father’ didn’t even have the means to marry ‘his partner’ (read- not wife, just the mother of his child of 17 years) because they’re prob living off welfare if she’s a ‘single mother’ and want a free payout!!!

  4. Hahaha! More like Mieses was blocking the SUV with his body so his buddies could extort him. He never expected that Lien would do what he did. Lien was right.

  5. The SUV driver went too far?? :))) What an idiotic question? His intention was to escape. The bikers’ intention was to challenge the law. (Many, if not all, of the bikes had no plates and Mieses had no licenses to drive.) This article has gone too far. It simply aims at victimizing the victim (Lien) even further. Sick article!!!!

  6. No doubt you are one blind paralyzed criminal who got shot after committing a crime. That’s why you strongly feel for your very own species. And I pray you will never be able to walk or live to ride again.

  7. Edwin Mieses, 32, never got a driver’s license in the Bay State, the
    Registry
of Motor Vehicles said, but he was frequently nabbed behind the wheel,
and even sentenced to jail for driving without a license, court records
show. Mieses has a pending case out of Lawrence District Court for
driving suspended, subsequent offense, said Carrie Kimball Monihan,
spokeswoman for the Essex County District Attorney’s Office. Mieses also
has 15 guilty findings for criminal offenses including distribution of
cocaine, possession of a firearm without a permit, knowingly receiving
stolen property, resisting arrest and several motor vehicle violations,
    court records show.
Mieses was sentenced to jail in 2004 for distribution of cocaine, in 2001 for
    operating
without a license, in 2000 for possession of a firearm, and in 1999 for
possession of marijuana, receiving stolen property, destruction of
property and attaching plates, according to court records.
    With all
the crimes he has committed, Edwin Mieses is described as ” a family
man”, ” a devoted father”…… It takes a sickening animal to come up
with an idea to help a criminal accuse the true victim. What kind of
animal will be sickening enough to help a criminal victimize the victim
further??? How can a sickening female dog be a celebrity lawyer???

It was disgusting to learn that the father of Edwin Mieses is a pastor. He
has produced an offspring that repeatedly violated the law. Yet he is sickening
enough to claim that he bears no anger towards the SUV driver while planning to
sue the SUV driver!!!! He should be very angry at himself. He has allowed his
son to challenge the law again and again!!!! The SUV crushed Edwin Mieses.
However, it was the father of Edwin Mieses who ruined his life, Had that pastor
told his son that it was wrong to drive without a license???? Had that pastor
taught his son that he should not have possessed cocaine???? Had that pastor
taught his son that it’s wrong to victimize a victim???

Or had that pastor taught him otherwise??? Is that why Edwin Mieses had to
bear such a thick book of criminal records?? The only thing I feel sorry for
Edwin Mieses is that he does not have a good father to guide him well. May God
get him a better father in his next life!!!! Amen!!!

  9. This is such a coincidence. I just had a fender bender with a young dad, young mom, and their infant child, I felt the need to help them by taking a crowbar and smashing in their sideview mirror and sunroof. They were so overcome by my act of generosity and helpfulness that they cowered in fear and the infant began to cry uncontrollably, unable to contain her amazement with my primitive method of altruism. I then pulled the father out the car and then began kicking him in the head with my steel-toed boot because my father always told me that kindness and generosity should know no limits. I was going to slash the tires of the car, also, but I felt it would be going too far and would make the young family obligated to return my generosity. It’s a good thing they didn’t have a chance to ask me for my insurance and registration because I sorta forgot to insure my vehicle since I sorta borrowed it from this guy who lives in an area where I usually steal vehicles.

HE IS TRYING TO HELP????? DO YOU HAVE A BRAIN????? We humans will be very fortunate if he causes no trouble in our society!!!!!

  14. Quick question for you. When stopped by a group of helmeted strangers in the middle of a
freeway, one of whom starts opening your door, another breaks your
mirror, and multiple riders start dismounting…. your reaction would be
    to just sit there?

  15. I see. So when stopped by a group of helmeted strangers in the middle of a freeway, one of whom starts opening your door, another breaks your mirror, and multiple riders start dismounting…. your reaction would be to just sit there?

  16. Did you even see the video? it clearly shows Cruz breaking stopping in front of the Range Rover. Common sense would tell if you don’t have a license you shouldn’t be on the road and if you got a long rap sheet you shouldn’t be misbehaving or you’ll get run over by a SUV.

  17. Wow, what a bunch of judge MENTAL people commenting on this horrific accident that lead to a hit and run and a brutal attack by angered people. I bet most of you would do the same thing to get vengeance or protect your family. How do you know if the wife of Mr. Mieses was not at the scene or someone at the scene told her the facts of the story so leave her alone and pray none of your loved ones suffers such a terrible thing landing them in the hospital and have some idiot say the stupid things you nasty people are saying about Mr. Mieses. You people are not that informed. When you are dealing with a DEADLY WEAPON, such as a car, then you need to think about your actions and not go hog wild and just run over people in your way no matter what your excuse is for doing it. I am sure if Mr. Lien had used his brain, he would have not hit the biker with his car in the first place. Mr. Lien is the person who started this domino effect and he nearly runs over another biker later in the video. Of course, neither the bikers or Mr. Lien used common sense and need to suffer the consequences. So quit making Mr. Lien the HERO cause he is not a HERO. I hope that the lawsuit takes him off the roads for good and he pays for what he did because that would be JUSTICE since the bikers involved in his beating are getting theirs. And I pray Jeremiah Mieses is able to walk again and lives to ride again.

  18. “Biker was trying to help him…” -that’s a totally misleading title. As Mieses hasn’t been conscious yet, other people are speaking for him, saying that he went to help another member of his biker gang.

Scallywag’s traffic must be super low to stoop to rewriting the news…

  19. When exactly do you think Alexian should have apologized–right after the gangbangers slashed his tires or when the entire mob was ready to attack the SUV? Funny how you talk about taking the law into his own hands when the bikers followed no laws! You want to use that argument you better make sure the people you are defending are not criminals first.

  20. An apology would have suffice.

By saving his own face, he deemed that
the bikers were wrong and ran over several of them. He should have
apologized for bumping into the first biker, and maybe get a few
scratches on his SUV as a result.
By taking the law into his own
hands, he endangered the life of his own family. Think an eye for an
eye. Not stopping to help the biker, and running over a few of them is
his own fault, no one forced Alex to move his SUV.
    The media trash
has tried to potray an innocent man with a loving family against a pack
of pitbulls. Far from the truth, most of the bikers had families too,
and they were not out to look for trouble. They were enraged at the lack
of civility from the so-called Columbia university-educated man.
Lose your dignity (or face for those who are Asian) for a day, so as to live to tell your story for another day.

  21. cruz was trying to stop the suv and when he did everyone crowded around it. meises stopped in the wrong place at the wrong time and was getting off his bike for what ever reason but it wasn’t to help anyone. lien was targeted for what ever reason as far as I can see and was afraid for his family. when crowded in and afraid it is fight or flight time and in this case it was flight by any means and with all the bikes crowded around him he had to make a hole to get away from them. it doesn’t matter if you can’t see into a vehicle due to tint, you always have to assume what you don’t see. how would they have felt if they had harmed the kid?? called it an accident or collateral damage???? this is stuck with stupid all the way around starting with cruz!!

  22. you all are missing the real question…how does his wife know he was trying to help? She talked to him? Hasn’t he been in a coma with a tube in his throat the whole time?

  23. That was no accident. They stopped Lien in the middle of a 55-65 MPH freeway on the west side of Manhattan by causing a fake accident. Which halted all traffic on that busy highway. Watch the video where the biker purposely brakes into the front SUV’s bumper.

    They slashed his tires.

They started breaking into the SUV.

When they finally caught up with him, they beat him to a pulp, knifed him, and left him for dead. Then they fled the scene.

Is that how people act in a so-called accident?

They’re criminals. They acted as a biker gang (oh, sorry- gang of bikers) – so prosecute them as a gang, including Mieses.

  24. True. There were no bikers on the ground to help at that point. So when Mieses got off his bike, it was not to help anyone, it was to join in on the confrontation against the SUV driver.

  25. Mieses’ wife, Dayana Mieses said he had been trying to help the first biker who was initially hit by the SUV when he, too, was hit.

In the video, the guy that stopped short and got hit was all the way in the front, and there was nothing to help he never fell off his bike.

  26. You can see someone trying to open his door, prior to him barrelling out of the way. Mieses mistake was stopping infront of the suv to rubberneck.
