Elizabeth Aguilar, Baton Rouge, Louisiana mom arrested after 1-year-old toddler, Nicholas fell out of car, only to be fatally run over in parking lot as parent faces series of charges. 

Baton Rouge woman was arrested after her unrestrained toddler child fell out of a moving truck she was driving only to be run over in a parking lot according to Louisiana law enforcement says.

Elizabeth Aguilar, 22, was driving her 2014 Dodge Ram pickup truck with her unrestrained child just before noon on February 20 when the 1-year-old, Nicholas Aguilar,  fell out of her vehicle and was run over at a gas station near the Amazon distribution site at the old Cortana Mall, Baton Rouge.

The little boy was then run over by the truck’s rear passenger-side tire. The child was rushed to a nearby hospital where he eventually died according to the Baton Rouge Police Department

Child negligence cited in toddler boy’s death

Additional investigation determined that the 1-year-old boy was in the rear passenger seat at the time of the tragedy and that the vehicle’s door opened when the defendant made the turn, WBRZ reported.

Charges against the mother had been delayed as investigators sought to understand what had led to to the boy falling out of the moving vehicle.

Come Tuesday, Aguilar was arrested on charges of negligent homicide, failure to use a child-passenger restraint system and a lack of insurance and registration. 

An arrest warrant further noted that neither of Aguilar’s children in the back of the vehicle were properly restrained, nor were there any child restraint seats. The vehicle also did have child locks that were not in use at the time of the crash.

Stated a GoFundMe, in a bid to raise funds for funeral costs for the toddler in part, ‘My sister is going through the unimaginable loss of her 1-year-old baby,’ the victim’s aunt wrote.

‘Our family is heartbroken, and we are trying to support her in every way we can during this incredibly difficult time. The sudden loss has left us all in shock, and we want to give her baby a proper funeral and burial to honor his memory and say our goodbyes with love and dignity.’
