‘Just bump him’ 13 year old boy charged in cyclist hit & run murder

Johnathan Overbay, Albuquerque, New Mexico teen boy arrested in connection to fatal hit and run murder of cyclist, Scott Dwight Habermehl caught on video being run over and footage shared on social media. Cops also seek to arrest, 16 year old teen, William Garcia and 11 year old boy. 

A 13-year-old New Mexico boy has been arrested in the fatal hit-and-run of a 63 bicyclist in Albuquerque that was caught on video from inside the boy’s stolen car, law enforcement said Monday.

The 13 year old teen, identified as Johnathan Overbay and believed to be the driver, along with 16-year-old boy, William Garcia, who was a passenger in the vehicle (who remains at large and is now wanted) were charged with an open count of murder, conspiracy to commit murder, leaving the scene of an accident involving great bodily harm or death and unlawful possession of a handgun by a person, the Albuquerque Police Department said in a statement.

An 11-year-old, who police say was also involved, is too young to be charged with murder and also remains at large. 

‘APD detectives are working with the DA’s Office and CYFD to determine what charges he may face and whether he can be held on those charges,’ Albuquerque police said in the statement.

The 13-year-old is expected to be booked into the Juvenile Detention Center. Detectives are searching for the 15- and 11-year-olds, CBS News reported.

Police mentioned the boys having previous run-ins with the child suspects before. In 2024, the 11-year-old and Overbay had their phones searched by APD in connection to another criminal case, KOB reported

Scott Dwight Habermehl, 63, the fatal hit and run cyclist victim, was riding to his job at Sandia National Laboratory early in the morning in May of 2024 when he was hit by a car after it swerved into the bike lane, according to police.

The crash was filmed from inside the car and shared on social media. In the recording, a voice believed to be the that of 13-year-old can be heard saying he is about to hit the bicyclist. Video shows the car accelerating along with the voice believed to be that of a 15-year-old saying, ‘Just bump him, brah.’

Loud sounds can then be heard in the recording, including ‘metal flexing,’ according to law enforcement. Of note the shared video showed one of the teen occupants, believed to be the 11 year old, sitting in the front passenger seat raising a gun and wielding it as video records the unfolding scene, KOB4 reported.

The video was posted on social media and reported to police. A middle school principal also reported the video to police after a student flagged it.

Will New Mexico prosecutors elect to charge teens as adults? 

According to his obituary, Habermehl got a PhD in physics in 1994 and worked for 30 years as an engineer at Sandia National Laboratories in Albuquerque. He left behind a wife and two sons.

‘He travelled to South America to challenge one of their tallest peaks and came back to tell the tale,’ his obituary says. ‘In his later years, he took delight in riding his horse in the spaces around their home in Corrales. He was a consummate outdoorsman and cared deeply for the wild spaces of the world.’

Under New Mexico law, teenagers ages 15-18 — and 14 in some instances after evaluation — can be tried in adult court only for first-degree murder after a grand jury indictment. Authorities can pursue adult sentencing in juvenile court for several serious crimes, said Dennica Torres, district defender for Law Offices of the Public Defender.
