Right decision? Cancer patient who ordered 42 pounds THC chocolate sentenced 4 years

Thomas J. Franzen a Chicago cancer patient who ordered 42 pounds of THC infused chocolate for self medication sentenced to four years jail. 

Disconcert has come to the fore with the revelation of a Chicago cancer patient who ordered a 42-pound (19-kilogram) package of THC-infused chocolates to self-medicate having been sentenced to four years jail.

Thomas J. Franzen, 37, of Montgomery pleaded guilty in Kane County Circuit Court to possession of more than 5,000 grams (176 ounces) of cannabis, a felony that carried a prison term of from probation to 15 years.

Defense attorney David Camic said prosecutors showed ‘compassion’ in dismissing the more serious charge of cannabis trafficking after authorities intercepted the chocolates in 2014 after being sent from a California dispensary.

Kane County court records revealed charges against the cancer suffer reduced to possession of more than 5,000 grams of cannabis, a felony that carried a prison term of four to 15 years that was also eligible for probation.

Franzen who has stage 4 cancer and was using the chocolates to relieve himself from symptoms, such as nausea Chicago’s Daily Herald reported.

An August 2018 court petition described Franzen suffering from testicular cancer that had spread to his lungs and abdominal cavity.

Reiterated Franzen’s lawyer, ‘He’s relieved to have it over. He wishes he could have done probation so he could maintain his course of treatment’. 

Franzen who has no previous criminal arrests is due in court June 14. The cancer sufferer will present results of new medical tests to Judge Clint Hull, who will decide when Franzen will begin serving his prison term. 

‘If he’s able to go in (prison), the judge will take him in,’ Camic said. ‘If he needs more time, the judge will give him time.’
