Majesti Faith Lee wrong way DUI driver charged with killing family of three in Harris County, Texas leaving a 3 year old boy who survived the crash orphaned. Driver had a previous DWI infringement dismissed. 

A 3-year-old boy in Texas has been left orphaned after a speeding ‘drunk’ wrong way driver crashed into the family vehicle, killing the boy’s parents and 5-year-old sister while returning home from a Christmas party.

Three-year-old Dieguito was the only member of the Contreras family to survive the collision, which happened on South Highway 99 near FM 1464 around 2am on December 20.

His mother, Lizbeth Rodriguez Contreras, 27, an elementary teacher and his five-year-old sister, Camila Peña, were pronounced dead at the scene according to a Facebook release from the Fort Bend County Sheriff’s Office.

The boy and his father, Diego Peña Jr, 26, were airlifted to hospital following the crash.

Despite doctors’ efforts, the father later died from his injuries. The young boy remains in hospital in stable but critical condition.

Authorities arrested Majesti Faith Lee, 27, who was treated for non life threatening injuries, charging her on Wednesday with intoxication manslaughter and one count of intoxication assault.

Investigators said the family of four, from Harris County, was driving north from the holiday party when Lee was allegedly traveling southbound in the northbound lanes.

Officials confirmed alcohol was a contributing factor in the crash.

Prior DUI infringement dismissed in Harris County

According to records, Lee had been charged with DWI in Harris County in September 2023. The charge was dismissed in May 2024 due to “insufficient evidence of defendant’s guilt,’ abc13 reported.

‘Our hearts are with the family as they endure an unimaginable loss,’ said Fort Bend County Sheriff Eric Fagan.

‘This tragedy is a painful reminder of how quickly lives can be changed when impaired driving occurs, and why making responsible choices behind the wheel is so critical.’

Contreras was a ‘beloved’ fourth-grade teacher at Metcalf Elementary School in Houston, where her ‘mini-me’ Camila also attended preschool, family members said.

Pena Jr. was a handyman, and nothing made his son happier than imitating his father doing work around the house, according to relatives.

The siblings of Lizbeth and Diego set up a GoFundMe in an effort to help support the young boy and the grieving family cover medical expenses.

‘Lizbeth and Diego’s world revolved around their children, as was evident since their young family was inseparable,’ the GoFundMe wrote in part. 

The fundraiser noted that Camila’s best friend was her little brother.

Lee’s bond has been set at $1,050,000.
