Indianapolis driver faces no charges after shooting & killing 29 year old driver with gun

A road rage incident in Indianapolis has led to a 29 year old man being shot dead after they approached a vehicle with a gun and proceeding to scream at the driver, who moments later shot the 29 year old dead. Prosecutors to date have declined to charge the other driver, citing self defence.

Footage taken from cellphone of another driver who witnessed the Tuesday evening incident shows the moment, Gavin Dasaur, 29, hastily approaching a white Chevy pickup truck and attempting to punch the driver while holding a handgun.

The driver tries to smack the punch away, with Dasaur shifting the weapon to his left hand as he berates the driver while pointing at them repeatedly with his right hand.

When can you act in self defense? 

Suddenly the unseen driver sitting in the pick up truck, points their own gun at Dasaur, firing repeatedly as the 29-year-old falls to the ground.

Dasaur immediately drops to the ground. The shooter never exited his vehicle during the confrontation which lasted only seven seconds.

The Indianapolis Metropolitan Police Department said the shooting broke out at around 8:15 p.m. near the intersection of South Emerson Avenue and Thompson Road.

Witnesses told police that the shooting occurred over a road rage incident between the Chevy driver and Dasaur, who was driving a black Honda, WTHR reported.

The driver of the pickup truck was initially detained but later released after investigators found that the driver may have been acting in self-defense.

‘The law says you can use reasonable force when you reasonably believe it’s necessary to prevent serious bodily force to yourself or another,’ said attorney John Tompkins according to FOX59.

‘The amount of the defense depends on the level of the threat,’ reiterated Tompkins.

‘He did not deserve to die this way!’ 

Although the decision to release the shooter was made after consulting with the prosecutor’s office, the case is not officially closed. Ultimately it will be up to the prosecutor’s office whether or not any charges should be filed in the case.

Cinthya ZaMora, Dasaur’s wife, condemned the shooting as she grieved her husband’s death.

‘He was a hardworking man that always went out of his way to help anyone and wanted to give the world to me and his family,’ she told the local outlet.

‘He did not deserve to die this way. It’s such a tragedy that my husband was murdered in cold blood,’ she said, but it remained unclear if she had seen the video of the shooting.

Of note, the married couple had only just gotten married two weeks ago, WRTV reported.

The IMPD said the investigation over the shooting and alleged road rage incident remains ongoing.
