What if the genders were reversed? A 31-year-old Colorado woman has been spared jail time despite admitting to having sex with a 13-year-old boy in June 2022.
Andrea Neenet Serrano become pregnant as a result of the sexual assault on the minor. She was freed shortly after her original arrest in July of last year on a $70,000 bond.
At the time of her arrest, Serrano admitted to the illicit relationship according to the Fountain Police Department.
Serrano originally faced two charges, sexual assault against a child and sexual assault against a child under the age of 15 by one in a position of trust; but Thursday morning Serrano entered a plea of guilty to the charge of incest — an amended charge added for Serrano to plead guilty to.
The charge of incest is a class four felony in Colorado. Incest refers to sexual activity involving two members of the same blood family. It remained unclear how the victim and her alleged abuser were related.
‘He looked at her like a mother figure’
Come Friday, Serrano’s lawyers agreed to a plea deal with prosecutors that will force her to register as a sex offender, while avoiding jail time for their client, according to the Colorado Springs Gazette.
Since her arrest, Serrano has given birth to the teen’s baby. The child is in her care. His family are planning to petition the courts to gain custody. The victim is now 14 years old.
Serrano was first questioned by police after a therapist found out and came forward with the allegations. After being interviewed by the Fountain Police Department, Serrano confessed to her crimes.
‘He looked at her like a mother figure and even called her “mom” before,’ according to the criminal affidavit in the case, cited by the Colorado Springs Gazette.
‘I feel like my son is robbed of his childhood. Now he’s having to be a father. He’s a victim, and he’s going to have to live with that for the rest of his life,’ the victim’s mother told KKTV after the plea deal was made public.
‘I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her,’ she added.
‘She (Serrano) sexually assaulted my 13-year-old son … She introduced him to drugs, she needs to be in jail,’ the mother of the victim said in court. ‘It’s a double standard. If she was a man, and my son was a girl she (Serrano) would be behind bars right now.’
Judge could still elect to exact punitive probation period during sentencing
Despite the objection to the plea deal from the victim’s mother Judge Moller accepted the agreed upon plea deal, and set for a sentencing hearing to take place May 18.
At the time of her arrest, KOAA reported that Serrano and her victim were living together for a time. It wasn’t immediately clear how the woman and the teen boy came to meet, let alone live together.
Despite prosecutors and the defense agreeing to the lesser charge of incest a judge could still sentence Serrano to 10 years to life of ‘sex offender intensive supervised probation.’
May’s sentencing is to determine the length of her probation.
Serrano is also due in court in March where she faces two additional misdemeanor charges for violating the terms of a restraining order.
The town of Fountain is located just south of Colorado Springs.
