Father charged with child porn tells nude pics were ‘family portraits.’

Brian Marten a 53 year old father has told authorities inappropriate photos of his 3 young daughters found on a computer belonging to his neighbor, Leslie Grey Vanaman were simply ‘family portraits.’

To date the man now stands charged for producing and receiving child pornography.

At the time the photos were said to be taken at a nudist colony, the  “private, gated” Sunsport Gardens Family Naturist Resort in Palm Beach, Florida.

Interestingly Vanaman, a photographer had gone on to be arrested in 2004 for possession of child pornography.

Federal authorities tell Vanaman was arrested and pleaded guilty to charges of receiving and possessing child porn last year. Evidence cited in the arrest warrant included photos of Marten’s daughters. He is now serving 60 years in federal prison.

Marten’s lawyer admits that some of the images of Marten’s children found on Vanaman’s computer were pornographic, but said Marten was unaware they had been taken. According to U.S. Attorney’s Office rep, Brandy Galler, Marten “cried when he viewed the images.”

Prosecutors have since told that the girls were between ages 8 and 12 when the photographs were taken, including that of close-up shot of one of the daughter’s genital area.

A photograph that Marten tells he did not know was ever taken nor ever giving permitted Vanaman take.

However, police say Martens signed releases and received more than 50 photographs containing child pornography from Vanaman. They also found emails between Martens, Vanaman and a third man discussing Vanaman’s “craft” and “the sensuality and sexuality” of his photographs. Martens also referred to “using his daughters as a passport” in the nudist community.

Reiterated Marten’s attorney, James Eisenberg: “The girls have no clothes on … but they’re not doing anything of a sexual nature,” Eisenberg said. “If they were young ladies who had clothing on, no one would consider them pornographic.”

“Totally nude … is the normal state of all the people who live there,” Eisenberg said. “In the context that everybody in this family are naturists … these photos are not lewd or pornographic in any way.”

“At the end of the day, it’s all a fact question for the jury [to decide],” told U.S Attorney rep, Brandy Galler.
